Welcome to Foodlista! These terms and conditions ("Terms") govern your access to and use of Foodlista applications and services ("Service"), which are owned and operated by VLK Studio s.r.l.s ("Company"), located at Via Pietro Martini 31, 09016 Iglesias (SU), Italy.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

1. Account Registration

Users are allowed to create accounts on the Foodlista platform. By creating an account, you agree to provide accurate, current, and complete information about yourself as prompted by our registration process.

2. Content Creation and Upload

Users may create and upload content, including but not limited to menu items, descriptions, and images. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish and share the content you create and upload.

3. AI-Assisted Features

Foodlista offers automated and AI-assisted features, including converting uploaded menu files into structured menus or products; generating, revising, or translating menu and editorial text; detecting potential allergens; and suggesting product attributes. These features may process menu content, images, and files supplied through the Service using third-party AI providers.

3.1 Probabilistic Outputs and Required Review

AI-assisted outputs are probabilistic and may be incomplete, inaccurate, or incorrect. They are suggestions to be reviewed, not certified data, and Foodlista gives no guarantee that they are accurate, complete, suitable, or fit for a particular purpose. Before publishing or otherwise relying on an output, you must review it and make any necessary corrections.

3.2 Allergens and Product Attributes

Allergen detections and product-attribute suggestions require particular care. Potential allergens and attributes or claims such as vegan, vegetarian, gluten-free, halal, and similar classifications may be generated, extracted, or suggested automatically. They are not verified or certified information and are not guaranteed to be accurate.

As the business user, you remain solely responsible for verifying the correctness, completeness, and compliance of all information you publish to consumers. AI-assisted outputs do not replace your legal obligations to provide food-information and allergen information, including those under Regulation (EU) No 1169/2011. You must verify allergen information and product attributes before publication and keep them accurate after publication.

3.3 Automatic Translations

Automatic translations are AI-assisted outputs and must be reviewed before publication. In the event of a discrepancy, the version of the content in its original language prevails over an automatically translated version.

3.4 Limitation of Liability for Automatic Outputs

To the maximum extent permitted by applicable law, VLK Studio s.r.l.s is not liable for losses, damages, claims, or consequences arising from AI-assisted or other automatic outputs. This does not limit liability that cannot lawfully be excluded or limited.

4. In-App Purchases and Subscriptions

The Service offers in-app purchases and subscription plans. Some subscription plans may include a free trial period. By purchasing goods or subscribing to plans, you agree to the specific terms and conditions related to those purchases or subscriptions.

5. Promotions, Contests, and Sweepstakes

Foodlista may, from time to time, offer promotions, contests, and sweepstakes. Participation in these activities is voluntary, and each will be governed by its terms and conditions.

6. Feedback and Suggestions

If you submit feedback or suggestions about our services, you acknowledge that the submissions are voluntary and agree that we are free to use these submissions as we see fit without any obligation to provide compensation or credit.

7. Amendments to Terms

VLK Studio s.r.l.s reserves the right to modify these Terms at any time. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.
